Under the new rule, codified in Florida Statute § 768.81(6), if a jury determines you were more than 50% at fault for your own crash, you are completely barred from recovering any compensation. If you are 50% or less at fault in the accident, you can still recover damages. Only the amount is lowered proportionally by the degree of fault. For instance, if your damages cost $200,000 and you are found 25% at fault, your recovery will be reduced to $150,000.
